Fact Witnesses, as well as Expert Witnesses, need to be properly managed to get the right support for a case. When fact witnesses are testifying on technical subjects, attorneys not skilled in the subject matter may be reluctant to push back on things that don't make sense. Attorneys may not even know what questions to ask in deposition to get information critical to their own expert's opinions. We help by reviewing the background of fact witnesses, reviewing the areas to which they are slated to testify, and then helping to prepare targeted questions to uncover facts that might otherwise be omitted. As Consulting Experts, we can participate in depositions or trial, listening to testimony in real-time and alerting the attorney to alternate questions or lines of questioning to elicit useful testimony.
Testimony of Expert Witnesses often make the difference in how the court responds to the technical issues of a case. The best subject matter experts, however, are not always skilled in legal matters, know how to draft a clear expert report, or how to stand their ground under cross examination. Further, many subject matter experts are so concentrated in their fields that they do not have the broad perspective required to relate technical details to legal issues at hand.
